My ID Service Terms

The following Service Terms apply to all MY ID users. Terms are updated from time to time and the user assumes the responsibility to familiarize themselves with any updates to these terms. MY ID reserves the right to upgrade, update, discontinue, close or turn off any aspect or feature, service, in part, or all at any time and without notice.

PLEASE READ THESE TERMS CAREFULLY: USERS RETAIN CONTROL OVER WHOM THEY INVITE TO THEIR ACCOUNT, ALL USERS AGREE, MY ID AND ANY OF ITS SUBSIDIARY ARE VOID OF ALL LIABILITY PARTIES ARE SOLELY RESPONSIBLE FOR POSTING AND ANY DISPUTES THAT RESIDE WITHIN PARTIES WHO LINKED ACCOUNTS. MY ID PROVIDES REVIEW PROCESS FOR PRO HOLDER USERS UNFAIR BIAS REMARKS AND RATING IF NOTIFIED WITHIN 24 HOURS OF THE POSTING. MY ID RESERVES THE RIGHT TO INVESTIGATE ALTER CHANGE OR CLOSE ANY ACCOUNT AT ANY TIME WITHOUT NOTICE AS A COMMON REMEDY TO DISPUTE REGARDLESS OF NOTIFICATION OR TIME OF NOTIFICATION. Reminder both Federal and Civil laws prohibit the use of fraudulent, misrepresented, or embellished remarks made publicly each user is in agreement to remedy actions without My ID involvement.

Section 1670.8 has no geographic limitations, so the law applies to any companies or persons doing business in California or out-of-state businesses with prospective or current Userss in California should also make sure they are in compliance with the law.  anti-SLAPP laws.

SERVICE:

1. My ID QR ID, Verification Programs, & Users of the Employee Performance Reviews

Users will use this Invitation Only Service to assess required qualifications for required career qualifications for employment, gig work, part time work, freelancers, consultants, etc. Userss should try to refrain from posting corporate logos and other outsourced trademarked resources within this site. . Userss who miss use a material breach of the Agreement will be removed.

The My ID sites are designed as a tool for users to quickly share qualifications. My ID offers a paid service option to verify qualifications, resumes, skills, licenses, degrees, work experience, rankings, and more. My ID is not a staffing agency, not a federal background service, nor does My ID replace formal desired background checks. Any user of My ID has the right to review content shared or not and posting and sharing of information is not a guarantee of employment or other expected outcomes (designed as content sharing only).

2. Employer Recruitment

Gig ID and its subsidiaries ID programs are designed to assist in Employer Recruitment by offering features to members that assisted tool to expedite employment purposes only as an aid to currently established hiring process. Gig ID is not designed as a background service, Federal or guidelines oversite agent.  Users breach of this Section will be deemed a material breach of the Agreement and could result in termination of Users account.

• Create Postings without an ability to verify content provided.
• Create Postings that intentionally misrepresent skills and ability.
• Create Posting that intentionally misrepresents personal identity.
• Create Postings that are identified reported or found to be inappropriate.

1.3 Users are responsible for all uploaded information is to be true and correct.

User is responsible for all postings, use and content through My ID, including but not limited to personal information, certificates uploaded, trade and skills information (verified or not verified), job descriptions, creatives, trademarks, images, URLs and postings or content therefor (collectively, “Postings”); and (ii) all content and property to which Postings may direct viewers, as well as redirects (“Destinations”). Users may not resell or transfer incorrect or false information. Users will not copy, duplicate, replicate, scrape or otherwise reproduce fake or other persons certificates or job history.  My ID reserves the right to remove any such Postings immediately and without prior notice to Users if verification is not verified. MY IDis not an active recruiting services beyond credential posting for recruitable positions. Users agrees that they will not, and will not enable or authorize any third party, by virtue of the Postings, Destinations, or use of the Service:

• Create Postings without an ability to verify content provided.
• Create Postings that intentionally misrepresent skills and ability.
• Create Posting that intentionally misrepresents personal identity.
• Create Postings that are identified reported or found to be inappropriate.

Posting with false or untrue information will result in a terminated account without notice.

Other reasons to terminate an account and or involve oversite agencies without notice include:

• “Spam” or otherwise contact applicants for purposes other than related to the specific employment opportunity described in the posting.
• Harass, stalk, or contact any applicant after they have asked not to be contacted.
• Create Postings in the United States without possessing valid Federal or State Employer Identification Numbers, if applicable, or create Postings in any other location in a manner that would not allow compliance with applicable tax and employment laws;
• Notices for jobs that require applicants to pay for employment or otherwise bear costs related to employment in violation of applicable law;
• Soliciting employees by intentional misrepresentation.
• Advertise employment positions, or otherwise engage in recruitment or hiring practices that would be a violation of the law in Users state or country, the state or country where the job is to be performed, or the applicable laws of the jurisdiction that governs the LSA between the parties;
• Engage in posting activities that violate MY ID’s job post discrimination policy or laws relating to job discrimination or eligibility to work.
• Any posting of an image My ID or Federal Law deems to be inappropriate.
• Create Postings that contain malware, spyware or any other malicious code or otherwise interfere with the operation of the Jobs Services or any device or system or breach or circumvent any security measure of MY IDor a third party.

2.1. My ID Content:

Users will have access to their content on the MY ID.com platform only. Users Users may only view the content online via the MY ID.com platform by registering for an account. My ID users (EMPLOYEE), have access to their accounts and My share and unshare access to their account to any My ID registered SUPERVISOR or EMPLOYER via email or scanning of Personal MY IDGENERATED QR ID.

Users may not violate the intellectual property or other rights of MY ID, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) using the word “MY ID” or our logos in any business name, email, or URL except as provided in the Brand Guidelines. Unless agreed to otherwise by the parties on the applicable ordering document, a Users User must be a then current employee, contractor, student or library patron depending upon the MY ID Learning service purchased by Users. For the My ID Learning service, the User Agreement will apply if Users connects its My ID Learning dashboard to its Users Users' MY ID.com profiles. Users User must be at least 18 years of age. Users/Job Seeker (Employee), will designate, invite any number of Supervisors/Employers/Potential Employers (“EMPLOYER”). Once the Employer excepts the Employee invitation to access the account, the employer will have limited right access to the users account. Can review posted qualifications for verified or not verified. Ether party can terminate shared account and employer can rate the Employees job performance and provide rating for others invited users to see. (See USE OF Dispute),

Users may only display content to REGISTERED MY IDUSERS. Users retains sole responsibility for all content (including third-party content) uploaded or provided by Users through our Services, My IDwill review, and remove such content deemed inappropriate without notice. All content Users uploads or provides through our Services must3be owned or licensed to Users. Each Users User must have a unique identifier for a login, such as a unique email address and password. Aliases are not permitted.

3. Reviewed Content and Analytics Services

3.1. Content and Analytics

MY ID may generate content and analytic data reports on Users's behalf derived from aggregating applicable Member profile data (“Insights Reports”). MY ID, in its sole discretion, may adjust or decline to include certain Member profile data in Insights Reports if MY IDbelieves the exposure of the Member profile data may compromise the privacy of Members or other MY IDUserss. Insights Reports generated by MY ID may or may not be shared with the user, even if MY IDprovides additional analysis of the Analytic Data at a later date (e.g. responses to data collected are intended as safety data and intended as open sourced but not guaranteed as such.). MY IDwill not release any underlying MY IDdata or third-party data used to generate Insights Reports. MY IDretains ownership of all rights, title, and interest to all content included in the Content and Analytic Reports (including any associated intellectual property rights). MY IDhereby grants Users a non-exclusive, perpetual, royalty-free, worldwide, non-transferable, non-sublicensable license to use, distribute, and display the Insights Reports for Users’s non-commercial activity. Users will be prohibited from externally publishing Analytic Reports or sharing Content Reports with third parties without MY IDprior written approval in each instance. My IDand each of its subsidiaries reserves the right to retain, with hold or distribute any data or content regardless of cause.

4.2. MY IDSERVICES

The MY IDSERVICE(“GCS”) Service is intended to provide Userss a self-serve on-demand, real-time access to gathered MY IDMember profile data. MY ID, in its sole discretion, may adjust or decline to include certain Member profile data in the GCS Service if MY IDbelieves the exposure of the Member profile data may compromise the privacy of Members or other MY IDUserss. MY IDwill not release any underlying MY IDdata or third-party data used in the GCS Service. MY IDretains ownership of all right, title, and interest to all content included in the GCS Service (including any associated intellectual property rights). GCS Data is derived from MY IDmember profiles and company pages and is provided “as-is”. MY IDdisclaims all liability regarding the quality, accuracy, completeness, and timeliness of the GCS Data. MY IDhereby grants Users a non-exclusive, perpetual, royalty-free, worldwide, non-transferable, non-sublicensable license to use, distribute, and display their data generated via the GCS (“GCS Data”) for Users’s internal use. Users shall not (i) publish externally or share the GCS Data with third parties without MY ID’s prior written approval in each instance; (ii) trade, sell/re-sell or otherwise monetize the GCS or GCS Data or access to the same, without MY ID’s consent; (iii) scrape or aggregate the GCS Data for the purposes of creating a competing service; or (iv) use the GCS or GCS Data to inform pre-investment activities and/or public security investment activities for itself or its end-clients.

Notwithstanding anything written in the LSA or any other agreement between the parties, (a) only Users and the specific Users Affiliates to which Users has purchased GCS on behalf of under this Order Form (“Authorized Affiliates”) will be eligible to use the GC; and (b) Users (including any successor-in-interest) shall not provision GCS to accommodate personnel arising in connection with a Change of Control. “Change of Control” means (i) the sale of all or substantially all of Users’s assets to a third-party; (ii) any change in the ownership of more than 50% of Users’s voting capital stock in one or more related transactions; (iii) Users’s purchase of all or substantially all of a third-party’s assets; (iv) Users’s purchase of more than 50% of a third-party’s voting capital stock in one or more related transactions; and (v) any Users merger, consolidation, or acquisition with, by, or into another entity. Pricing for add-on GCS Services requested in connection with a non-authorized Affiliate or a Change of Control will be at MY ID’s then-current list rates. Users’s breach of this Section 4.2 will be considered a material breach of the Agreement.

4.3. MY ID Sales Insights.

The MY ID  Good Clinical Practices (“GCP”) Service provides Userss self-serve on-demand, real-time access to aggregate MY ID company data. MY ID, in its sole discretion, may adjust or decline to include certain company data in the GCP Service if MY ID believes the exposure of the company data may compromise the privacy of Members or other MY ID Userss. MY ID will not release any underlying MY ID data or third-party data used in the GCP Service. MY IDretains ownership of all right, title, and interest to all content included in the GCP Service (including any associated intellectual property rights). MY IDhereby grants Users a non-exclusive, perpetual, royalty-free, worldwide, non-transferable, non-sublicensable license to use, distribute, and display reports and data generated via the GCP Service (“GCP Data”) for Users’s internal use only. Users shall not (i) publish externally or share the GCP Data with third parties without MY ID’s prior written approval in each instance; (ii) trade, sell/re-sell or otherwise monetize the GCP Service or GCP Data or access to the same, without MY ID’s written consent; (iii) scrape or aggregate the GCP Data for the purposes of creating a competing service; or (iv) use the GCP Service or GCP Data for talent acquisition. GCP Data is derived from MY IDcompany pages, and MY IDdisclaims all liability regarding the quality, accuracy, completeness, and timeliness of the GCP Data. Should Users’s Agreement or ordering document with MY ID specify a limit on the number of times GCP Data may be downloaded by Users, such downloads must be completed during the contract term and may not be carried into a new contract period. If the term of Users’s Agreement or ordering document is greater than 12 months, the download limit is fixed annually and any unused downloads may not be carried into the subsequent year of the Agreement or ordering document. Users’s breach of this Section 4.3 will be considered a material breach of the Agreement. Any GCP Service Fees and Requests are non-cancelable and non-refundable.

5. ELEVATE SERVICE STAR RATINGS

USERS WILL MAINTAIN A SOCIAL MEDIA POLICY AND AGREE TO ALL TERMS WITH THE POLICY. ONLY A USER DESIGNATED AND VERIFIED AS  SUPERVISOR(S) IS/ARE AUTHORIZED TO POST CONTENT AND THEN ONLY AT THE REQUEST OF AN EMPLOYEE.

USERS ARE ENCOURAGED TO REPORT VIOLATIONS OF CALIFORNIA’S ANTI-SLAPP LAW AND RELATED STATE AND FEDERAL STATUTES
